Robert Gravois practices in all areas of intellectual property, with a focus on IP litigation, patent and trademark portfolio development, and IP-related licensing and employment law issues. In addition to enforcing IP rights and defending against infringement claims in U.S. district courts throughout the country, Robert has represented both patent owners and challengers in dozens of post-grant proceedings at the Patent Trial and Appeal Board (PTAB) and the Central Reexamination Unit (CRU) of the U.S. Patent and Trademark Office (USPTO), including inter partes review (IPR), covered business method (CBM), post-grant review (PGR), interference, and ex parte reexamination proceedings.

Robert also provides strategic counsel to clients on IP portfolio development, licensing, anti-counterfeiting efforts, due diligence, and corporate IP strategy. He has also drafted hundreds of patent applications and is experienced in rendering legal opinions concerning infringement/non-infringement and validity/non-validity of IP rights.

Before joining PKH, Robert served as the Assistant General Counsel of Intellectual Property at ADT Security Services, where he was involved in all facets of IP. Before that, Robert was a partner at a nationally-recognized intellectual property boutique.

Robert holds a J.D. and B.S. in Electrical Engineering from the University of Florida. He is admitted to the Georgia and Florida bars and is registered to practice before the USPTO. Robert resides in South Florida and frequently travels to PKH’s main office in Atlanta.

    • Obtained a favorable jury verdict and multi-million-dollar damages award against a computer manufacturer for infringement of a patent involving blade server technology. Also successfully defended the patent in multiple Inter Partes Reviews (IPRs) and appeals to the Court of Appeals for the Federal Circuit.

    • Represented a musical equipment manufacturer in securing a reversal by the Federal Circuit of an IPR decision that had applied an incorrect legal standard in its obviousness analysis. The USPTO’s Manual of Patent Examining Procedure (MPEP) includes a discussion of the court’s decision to guide patent examiners on the proper obviousness analysis that must be applied during patent examination.

    • Represented a manufacturer of professional audio equipment in assertion of several patents relating to digital signal processing and power factor correction for audio amplifiers.

    • Represented a patent owner in several IPRs of several patents related to media streaming and location-based tracking.

    • Represented a financial technology company and its indemnitees in defending against allegations by a non-practicing entity of infringing a patent involving electronic banking.

    • Enforced multiple patents directed to dual-flush toilets against a toilet component manufacturer. Also successfully defended the validity of the patents in multiple IPRs brought by the manufacturer.

    • Defended a manufacturer of stevia, a sugar substitute, accused of infringing patents relating to producing glucosylated steviol glycosides.

    • Defended a plumbing component manufacturer in multiple IPRs involving patents directed to plumbing components.

    • Represented a manufacturer of instrumentation used for food production in defending against claims of trademark infringement.

    • Represented a children’s products manufacturer in a patent interference proceeding involving infant bassinets.

    • Represented a laboratory equipment service provider in a dispute involving copyrights, unfair competition, and publicity rights.
